1. Acceptance of These Terms
These Terms of Use ("Terms") form a legally binding agreement between you ("user", "player", "you") and ArcticFunFusion ("we", "us", "our"), the operator of the website located at arcticfunfusion.com. By accessing the website or using any of its features, you confirm that you have read, understood and accepted these Terms in full. If you do not agree, please leave the site immediately.
2. Nature of the Platform — Not Gambling
ArcticFunFusion is a free social gaming platform. It is not an online casino, sportsbook, betting exchange, lottery, fantasy operator or any other form of gambling provider. The platform does not constitute gambling under Canadian law, including but not limited to Sections 197–209 of the Criminal Code of Canada, because:
- no consideration (money or thing of value) is ever required to play any game;
- no real-money prize, cash equivalent, gift card or item of monetary value can be won;
- virtual coins cannot be redeemed, exchanged, withdrawn, purchased, sold, transferred or converted into anything of real-world value, by us or by any third party;
- all outcomes are entirely cosmetic and exist purely for the purpose of entertainment.
3. Eligibility
You may use ArcticFunFusion only if you are at least 18 years of age (the legal age of majority in Canada varies by province; we use 18 as the minimum). You must also have the legal capacity to enter into a contract under the laws of your jurisdiction. By proceeding past the age-confirmation gate, you represent and warrant that you meet these requirements.
If we become aware, or have reasonable grounds to suspect, that a user is under 18, we will deny access without notice.
4. Virtual Coins
4.1 What they are
"Virtual coins" are an in-game counter displayed by our games (Plinko Drop, Hi-Lo Cards, Mines Gold, Crash X and any future titles). They are stored entirely in your browser's localStorage and exist only within the context of a particular game and a particular browser.
4.2 What they are not
Virtual coins are not currency, securities, tokens, NFTs, crypto-assets, gift cards or vouchers. They have no monetary or commercial value. You do not own them in any property-law sense — they are simply a number we display.
4.3 No redemption
Virtual coins cannot be redeemed for money, prizes, goods, services or any other item of value, whether from us, our affiliates or any third party. They cannot be transferred between users.
4.4 Refills
Each game grants you a starting balance of 1,000 virtual coins. When your balance reaches zero, you may refill it back to 1,000 at zero cost, as many times as you like. We reserve the right to change these amounts at any time.
5. Acceptable Use
You agree not to:
- use the site if you are under 18 or otherwise not legally eligible;
- attempt to modify, decompile, reverse-engineer or interfere with the games or their code;
- use bots, scrapers, automated tools or any technical means to gain advantage or extract data;
- misrepresent your age or identity;
- use the platform for any commercial purpose without our written permission;
- upload or transmit harmful code, viruses or unlawful content via our contact form;
- infringe any intellectual property, privacy or other rights belonging to us or any third party.
6. Intellectual Property
All content on ArcticFunFusion — including text, graphics, illustrations, logos, code, design, interface elements and the structure and selection of game mechanics — is owned by ArcticFunFusion or licensed to us, and is protected by Canadian and international copyright, trademark and other intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable licence to use the site for personal, non-commercial entertainment only.
7. No Warranties
The platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability and uninterrupted availability. We do not warrant that the site will be free of errors, defects, downtime or data loss.
8. Limitation of Liability
To the maximum extent permitted by law, ArcticFunFusion and its officers, directors, employees and agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of (or inability to use) the platform, including without limitation loss of data, loss of virtual coins (which have no value anyway), or any emotional or psychological effects. Our aggregate liability shall not exceed CAD $50 in any case.
9. Responsible Gaming

10. Privacy & Cookies
Use of the platform is also governed by our Cookie Policy. We process personal data in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.
11. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted on the homepage for at least 14 days. Continued use of the site after changes take effect constitutes acceptance.
12. Governing Law & Disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively by the courts of British Columbia, located in Vancouver, and you consent to their jurisdiction.
